Buying or selling a home is one of the biggest financial decisions most people make in their lifetime. Whether you’re a first-time buyer, upgrading to your dream home, or selling an investment property, the process can be both exciting and overwhelming.
At CVC Law & Conveyancing, with offices in Wollongong, Shellharbour, Corrimal, Thirroul, and Nowra, we’ve been helping individuals and families across the Illawarra and South Coast navigate property transactions for years. In this article, we’ll guide you through the key steps, legal requirements, and potential pitfalls of buying and selling a home in NSW.
Here are the top reasons why you should never just sign a contract without proper legal review:
Buying a Home in NSW
Step 1: Do Your Research
Before making an offer, research the property market in your desired area. Consider factors such as property prices, future developments, and proximity to schools, shops, and transport.
Step 2: Obtain Pre-Approval for Finance
Speak to your lender or mortgage broker to determine how much you can borrow and obtain pre-approval. This step ensures you’re ready to act quickly when you find the right property.
Step 3: Review the Contract of Sale
Once you’ve found a property, the seller will provide a Contract of Sale. This document outlines the terms of the sale, including the price, settlement date, and any special conditions.
It’s crucial to have a solicitor or conveyancer review the contract to identify any potential issues, such as zoning restrictions or unapproved works.
Step 4: Conduct Property Checks
Arrange a building and pest inspection to uncover any structural issues or infestations. If you’re buying a strata property, request a strata report to assess the financial health of the owners’ corporation.
Step 5: Exchange Contracts and Pay the Deposit
Once all checks are complete and both parties agree to the terms, contracts are exchanged, and you’ll pay the negotiated deposit (typically 5 or 10% of the purchase price).
Step 6: Settlement
Your Conveyancer will handle all legal and financial transactions on settlement day. On this day the balance of the purchase price is paid, and ownership of the property is transferred to you.
Selling a Home in NSW
Step 1: Prepare Your Property for Sale
First impressions matter. Declutter, clean, and consider making minor improvements to enhance your property’s appeal.
Step 2: Engage an Agent and Solicitor/Conveyancer
Choose a real estate agent to market your property and a solicitor/conveyancer to prepare the Contract
of Sale, which must include key documents such as:
- Title details
- Zoning certificates
- Drainage diagrams
If the property has a pool, registration of the pool and inspections are a requirement.
Step 3: Negotiate Offers
Once your property is on the market, potential buyers will submit offers. Your agent will help you negotiate the best price and terms.
Step 4: Exchange Contracts
When you’ve accepted an offer, contracts signed by all parties are exchanged, and the buyer pays the deposit.
At this stage, the sale becomes legally binding (unless a cooling off period has been negotiated).
Step 5: Settlement
Your solicitor or conveyancer will ensure all legal and financial aspects are completed on the agreed settlement date. On this day ownership of the property is transferred to the buyer, and you’ll receive the balance of the sale price.
Common pitfalls to avoid
- Failing to review contracts thoroughly: Hidden clauses or unclear terms can lead to disputes down the track. Always seek professional legal advice.
- Skipping inspections: Issues uncovered after settlement can be costly to fix. Inspections
are essential for peace of mind. - Underestimating costs: Remember to budget for stamp duty, legal fees, agent commissions, and moving expenses.
